Enforcement

The Enforcement section conducts inspections in response to workplace accidents, employee complaints, and targeted programs to improve health and safety conditions. Monetary citations may be issued for violations of standards. In addition to worksite inspections, the Enforcement section certifies training courses for asbestos abatement workers, explosive handlers, and professional painters applying hazardous paint. AKOSH has jurisdiction over most employers in the State of Alaska. For coverage exemptions, please see the most current jurisdictional guide: https://labor.alaska.gov/lss/jurisguidev7.pdf.

Employers who disagree with citations, penalties, or abatement dates issued by AKOSH may formally contest any of these items before the OSH Review Board. Instructions to contest are included in citation packets issued by AKOSH.

Whistleblower Protection

AKOSH is committed to protecting workers who raise safety and health concerns or exercise their rights under the Alaska Occupational Safety and Health State Plan. Employees may report hazards, request inspections, participate in inspections, advocate for workplace safety and health improvements, report work-related injuries or illnesses, or file health and safety complaints without fear of retaliation. Retaliation can include termination, demotion, intimidation, reduction in hours, reassignment, or any taken or threatened adverse action because an employee engaged in protected activity.

AKOSH Enforcement investigates credible allegations of retaliation to ensure employers do not discourage reporting of unsafe conditions or cooperation with AKOSH, OSHA, or other entities responsible for workplace safety and health. When complaints meet specific criteria, AKOSH conducts a thorough, impartial investigation and pursues corrective action and remedies when appropriate.

To file a whistleblower complaint, click here or call AKOSH at (907) 269-4940. If a complaint falls outside AKOSH jurisdiction, it will be referred to the appropriate agency.

AKOSH encourages employers to foster a workplace culture where safety concerns can be raised openly and without fear. Protecting whistleblowers strengthens Alaska’s safety and health system by ensuring hazards are identified and corrected before injuries or fatalities occur.

Retaliation

Employees who engage in protected activity, such as raising health and safety concerns in the workplace or filing a health or safety complaint with AKOSH, are protected from employer retaliation. AKOSH investigates complaints that meet prima facie evidence of employer retaliation against employees pursuing appropriate corrective action. To file a Whistleblower complaint, click here or call AKOSH at (907) 269-4940.

If your complaint does not fall under AKOSH jurisdiction, you will be referred to the appropriate agency.
